architect's professional fee

Hi all,

My friend seeking opinions and solutions about his/her problem in getting paid her/his professional fee from the previous employer.

My architect friend is a license Architect that is employed in a  company. He/she design and singed various projects for the company. Then one day, he/she tried to take his/her professional fee for those projects. But certainly the president of the company doesn't want to pay. The problem is there is no written agreement that he/she can get those payment only verbal agreement has been done. Could he/she be possible to get paid even if its verbal agreement? The only evidence of amount will be paid for my friend was indicated at the Bill of materials(BOM/BOQ) submitted at the city engineers office?

I read some of the architects code stating that an architect can charged a certain percentage but i don't know if it is applicable if there is no written agreement have done and if its applicable when the architect is employed or not. 

Comments and suggestions are gladly appreciated.

ano pa agreement nila about sa bayaran? monthly? project basis? percentage?
depende kase yan sa napagusapan nila.

Yung napag usapan nila per project makakakuha siya ng1-2% s total contract price,nung naniningul na siya ayaw na mag bayad ng company. Meron pa ba sya habol kahit na verbal lang ung agreement nila?

Kung ano ang napag-usapan nila ung ang masusunod, dapat nga talaga may makukuha siya diyan ang mahirap lang wala silang kasulatan, at nagtratrabaho siya diyan sa company dati so mahihirapan na siyang singilin kahit ano pa ang sabihin niya wala siyang maipapakita na basehan sa napag-usapan nila, mahirap kasi ung verbal lang.

In all parts of the world, verbal agreement is useless....sayang lang.

Hi, first of all, mahihirapan na friend mo since verbal lang usapan and hindi na siya employed right? The president will just simply deny the agreement. Cguro pwede siya humingi siya ng tulong sa NLRC baka matulungan siya but the process will take long.

OT : why do you address pala your friend as his/her?

Actually naging harsh yung company sakanya, nung nag singil na siya s payment yung president ng company hindi na siya pinapasok s office nila. Two days nag hindi n siya pinapasok may pinapapirma sakanya ng waiver and quitclaim kasama ung certain amount. Nag consult sya s lawyer sabi na pwede nyang ihabol s NLRC if there is a law na nagdedeclare s mga architect upon sign and sealed na ang plan na may automatic ma sisingil ung architect. Kaya po kami ng hihingi ng payo s mga experienced architects out there.

dapat nung una palang may kasulatan at kasunduan na sila na may % sya na makukuha.. and sya yung nakapirma sa mga plano at ngayon tinanggal na sya..dapat gawa sya ng affidavit na nagsasaad na hindi na sya connected sa company na yun,or resign na sya sa project na yun and hindi na sya liable kung ano man ang mga hindi magandang mangyayari sa site. signed ng company, owner ng structure at sino mang involved sa project.. kasi pag may ngyari sa project na hindi maganda like accident... involve parin yung architect na friend mo..

I think kailangan maiconsult mo ito sa UAP or sa PRC. May laban sya dito kasi nasa paper ang pangalan nya. at meron BOQ.

Ang kaso mo dito is ikaw ang architect on record, pero wala kang kinita. Paano mangyayari yun di ba? Tanong mo na din sa lawyer ang ganitong situation kasi meron tayong evidence at yun yung construction drawings.

Sana makakuha ka ng magaling na lawyer. Pwede kasi na yung bayad sa kanila at percentage ng damages na makukuha nyo sa kaso.
