The PRBoA SUES Former DPWH Secretary Ebdane, et. al. for Violations of Anti-Graft Laws Relative to the Implementation and Enforcement of Republic Act No. 9266 and of P.D. No. 1096 and their IRRs

At 2:45 p.m. on 05 November 2009 (Thursday), the Professional Regulatory Board of Architecture (PRBoA) filed a Complaint before the Office of the Ombudsman against former DPWH Secretary Ebdane, 2 of his Undersecretaries, the Philippine Institute of Civil Engineers (PICE) and law book publisher Atty. Vicente B. Foz for violations of R.A. No. 3019 (Anti-Graft and Corrupt Practices Act) and R.A. No. 6713 (The Code of Conduct of Government Officials) relative to the implementation and enforcement of R.A. Act No. 9266 (The Architecture Act of 2004) and of P.D. No. 1096 (the 1977 National Building Code of the Philippines/ NBCP) and their respective implementing rules and regulations (IRR).

The PRBoA is currently preparing similar Ombudsman complaints against LGU officials in Metro Manila and provincial cities for filing by early December 2009. The PRBoA is also preparing drafts of criminal complaints against private individuals violating R.A. No. 9266, particularly unregistered persons who prepare, sign or seal architectural plans and documents e.g. perspectives, floor plans, sections, elevations, ceiling plans, roof plans, finish schedules, specifications, etc. for all types of buildings sited on Philippine soil.

Unregistered persons specifically include civil engineers who sign and seal architectural plans and documents. Criminal complaints may also be filed against clients and building owners who hire such unregistered persons, including foreign architects who do not possess temporary/ special permits (TSP) to practice architecture in the country.

The public, particularly national and local government officials are strongly urged to periodically check the PRBoA website at www.architectureboard.ph for references/ information on the mandated compliances under R.A. No. 9266. Thank You.

Problema talaga sa atin yan, unprofessionals na nga Corrupt pa, maraming magagaling at professionals na di nakapagtrabaho dahil sa bulok na sistemang umiiral sa atin...

The Secretary of the Department of Public Works and Highways issued DPWH Memorandum Circular No. 2 directing all building officials “to process and issue the necessary permits and certificates to all applicants/owners notwithstanding whether the designs/plans and/or other pertinent documents x x x prepared, signed or sealed by either a registered architect and/or civil engineer” until there is a final and executory decision rendered in the above-mentioned cases.” The cases referred to are “PICE, et al. v. Hon. Secretary v. Hon. Secretary Hermogenes Ebdane, Jr.” and “PSSE v. DPWH Secretary.” The United Architects of the Philippines (UAP) has issued a public notice stating its stand on the matter. It should be emphasized that it is the Secretary of the Department of Public Works and Highways (DPWH) who is the National Building Official. Therefore, it is the National Building Official who implements the National Building Code of the Philippines and not the UAP. Actions of the National Building Official are not subject to the prior approval of other administrative agencies. The opinion of the UAP notwithstanding, DPWH Memorandum Circular No. 2 is legally binding and should be strictly followed by all building officials.

hindi basta2x itutupad ng mga Buidling Officials ang bagong IRR ng PD 1096 until such time na may memo galing sa secretary..
pag may memo walang problema yan.. sa ngaun yan lang muna.. hayaan na natin sa korte ang issue na ito..

kaya pala nagtaka ako kahapon bro kumuha ako ng bldg permit form sa city engrs ofc at wala na ang form ng architectural at structural.... balik naman daw sa dati....

salamat din sa pagsuporta...simple lang naman ang pinaglalaban ng mga arkitekto...ung arkitektural sheet ipaubaya sa kanila.ung structural sheet wala kming pakialam dun...ang kay pedro kay pedro ang kay juan kay juan...eh bakit ang mga engr's ang pumipirma sa mga architectural sheets?arkitekto ba sila????sana wala na lang arkitekto at sila na lang ang lahat pumirma sa sheet na para sa arkitekto.makalusot man sila sa PD 1096 di sila makakalusot sa R.A. yan tlga prob nating mga architects. sa probinsya kung minsan nagpapatayan pa dahil jan. lets hope for the best. may araw din mga c.e na yan. hehehe. by the way my father is a C.E but pusong architekto. hehehe

All Building Officials are directed to process and issue the necessary permits and certificates to all applicants/owners notwithstanding whether the "DESIGN" plans and/or other pertinent documents that are submitted, particularly those enumerated in Section 302(4) of the Revised IRR, are prepared, signed and/or sealed by either registered architect and/or civil engineer" until there is a final and executory decision rendered in the above cases. - Sec Ebdane

mismo si ebdane nde nya mabanggit na architectural, baka para nde obvious......baka nde nya ata nababasa na naka-classify ang mga plans and drawings in their own respective disciplines.... nde nya ata nababasa ung IRR ng PD 1096.

i just hope for the best regarding this issue.....

ang masasbi ko lng dyan... d nmn sila marunong gumawa plano etc.tapos aangkinin nila pati architectural.ang papangit nmn ng mga design nila... d nila alm ung circulation ng tamang paggagawa ng plano...marami ng civil sa pinas almost 170,000,pero taung mga architects nas 23,000+ plang pero hindi nila kayang tibagin ng UAP...

c ebdane wala nmng alam un. pulitika lng bakit cya naupo bilang secretary...baka hindi pa marunong magbasa ng plano un... e1 basta naiinis ako...
