what case to file?

Hi good morning po!

just want to ask lang po about sa issue sa company namin ngayon. ang company po namin ang in-charge sa design sa isang foreign developer dito sa phil. our problem is that nagkaroon ng misunderstanding ang boss ko na korean architect and our client which is a korean also. ang reason ng problem is that the client dont want to pay the necessary amount for a certain scope of work as per their contract. so my boss hold the drawings until they didnt pay. they fought over the phone and saying verbally for the termination of their contract. so ung client, immediately na humanap ng company who took over the work. And dahil po ung mga drawing files namin eh downloadable sa isang Korean file sharing, not knowing with us, ung mga files for that project binigay po nila sa new company. What will be the possible case na puede e file to our client?

i strongly suggest na magpa-advice kayo sa isang lawyer. This is a serious case.

pwede nyong i-sue ang korean client. provided dito sa Philippines ang project.
pwede nyo din i-sue yung new company na kumuha ng project.
pwede din kayong ma-sue for holding the drawings.

ganun ang mga nakikita kong pwedeng cases.

madami poh mam...depende sa grounds,try to browse RA 8293...irreconcilable na ba?pede kasi itong malusutan nila,depende sa contract...both parties ba may power to terminate such contract?first thing to do is to look at your contract...second consult a lawyer,pero mahabang process ito mam...baka ung ipapanalo nyo sa kaso eh pambili lang ng medikol...in short saket sa ulo lang...pagusapan nyo na lang,kung kaya pa maayos...ok naman yang mga korean kausap...

mga sir and maam, thanks po sa mga responses nyo. hope na sana mapagusapan nila ng maayos. ang nakakasakit pa ng loob eh ngayon sila nag ccomplain regarding sa total contract price for the architectural work which I explained to them na kaya ganun eh, dahil may named value ang kinuha nilang designer. and one thing more po delayed mga payments nila sa amin, kaya ganun po na hinold namin ung mga drawings that time.

ma'am tanong ko lang bakit free na madownload ung mga project files nyo? i think you have to be more cautious with it... and yah... better consult a lawyer... 100% intellectual property rights ang unang magiging kaso... pero hindi ko rin sigurado baka magkaproblema kayo on that area kasi hindi ko alam kung may copyrights ba ung downloadble files nyo...

i hope you will still get what you deserve... pinaghirapan nyo yan...

korean po kasi ung website na un eh,and un lang ang way para ma download ko ung mga drawing files, so my boss said me to asked assistance to them, he gave me the username and password. nag ooffice kasi kami sa mismong office ng client namin. kasi dito sa pinas considered as one company lang po kami.
